Terminology

The following terminology applies:

1. MoofFixie refers to the MoofFixie App.
2. "You" refers to you as buyer of the application.
3. "We" refers to the legal owner of MoofFixie, at the moment of writing, Tim Kunst.

Consent

By downloading and using MoofFixie you agree to these terms and conditions. Do not continue to use MoofFixie if you do not accept the terms and conditions.

Ownership and Usage

We own all intellectual property, copyrights and all trademarks for MoofFixie. You are not permitted to copy, modify MoofFixie, entirely or in parts.

Your Privacy

See the Privacy Policy for the policy about your privacy.

Data Security

Your phone and MoofFixie provide access to your bike. It is your responsibility to keep access to your phone secured, because this potentially gives access to your bike too. Jailbreaking or rooting your phone may compromise security to your phone and therefor to your bike. We are not responsible for the security of your phone and/or bike.

Responsible use

You are and remain responsible for responsible use of your bike according to your local law at all times.

Disclaimer

We can not be held reliable in case of abuse. Any injury, physical or other damage caused with your bike is strictly your responsibility. We disclaim any warranties and representations to the extent permissible by law, and specifically:

• Limit our liability for death or personal injury resulting from negligence
• Limit our liability for fraud or fraudulent misrepresentation

Updates

We may provide you updates to MoofFixie free of charge. For instance for bug fixes. MoofFixie may be updated without any notice. Only the most recent version is supported. Major new functionality may be released as a new version that needs to be purchased separately.

Internet connection charges

Certain functions in MoofFixie require an active internet connection to function, for instance navigation. Internet connectivity may involve costs. We are not responsible mobile data cost caused by using MoofFixie, nor are we responsible for reduced functionality without internet connectivity. In the settings of your iPhone you can disable data usage for each application. If so desired you can use this to prevent MoofFixie from generating undesired costs.
